All business undertaken between Kidtection (“the Agency”) and the employer (“the Client”) is subject
to these terms and conditions. These terms and conditions shall represent a legally binding contract
between the client and the agency. The verbal/written instruction by the Client to the Agency to
submit suitable Candidates for contact or interview or arrangement of interviews shall constitute
as acceptance by the Client of these terms and conditions. The term “Candidate” means a person
introduced by the Agency. The Agency is acting as an employment agency. In the event of any
conflict between these terms and conditions and any other terms and conditions, the former shall
prevail unless expressly agreed in writing to the contrary by the Agency.
a. An introduction is deemed to be made when the Agency notifies the Client of a candidate’s name
and / or provides the Client with the candidate`s details.
b. If a candidate introduced by the Agency accepts an offer of employment from the Client, a fee shall
c. Introductions are confidential. Clients passing on information relating to candidates introduced to
them by the Agency and resulting in subsequent employment elsewhere will be liable for the full fee
d. The Agency acts as an introduction Agency only and whilst every care and reasonable effort is
made to check the references are genuine, we strongly recommend that the client make their own
enquiries and checks.
Clients and Candidates must complete the online Registration Form or sign the Terms and Conditions
and return both to the Agency, before they are accepted and taken on our books. If registering online,
filling the online registration form constitutes confirmation of acceptance of the Agency’s Term’s &
a. The Client agrees to notify the Agency, either verbally or in writing, as soon as an offer of
employment has been made and to pay the agreed fee within 7 days of the invoice date and prior to
employment commencing based on acceptance of a position by a Candidate.
b. The Candidate will not commence employment prior to full settlement of the invoice. A surcharge of
10% will be added to all fees not settled after 7 days of the invoice date. A surcharge of 20% will be
added to all fees not settled after 14 days of the invoice date. All placement fees quoted are exclusive
Candidate’s salary and other chargeable expenses of the Candidate and/or Agency.
c. If our invoice is not paid by 30 days of the invoice date, the Agency reserves the right to pass it to a
debt collector which will incur an additional fee of 30% of the total invoice which will be charged to the
Client plus debt collector fees.
d. The Client will be held responsible for bypassing the agency in cases where the family or the
Candidate failed to inform the agency about the start of employment. If the Candidate is solicited to
work for the Client with the intention of bypassing the agency fees then the Client will be invoiced a
penalty fee of £499 on top of the invoice.
e. If any position is extended or the Client wishes to add extra hours, the Agency will recalculate
the amount due and issue a revised invoice so that the appropriate fee can be charged; the revised
introduction fee will become due and payable within 7 working days of the date of invoice.
a. If a Candidate (who has been offered and has accepted a position with a Client) either does not
start employment or leaves within 8 weeks of starting employment with the Client then the Agency will
provide one replacement candidate only from a suitable selection at no extra cost (unless the Client`s
requirements, job description, or the nature of the experience sought have altered, or the salary
and conditions offered are not at current market rates, in which case an additional payment may be
required). This is subject to the following conditions:
i. The Client informs the Agency within 5 working days of the termination of employment.
ii. All fees were settled within 14 days from the invoice.
iii. The booking has not been cancelled by the Candidate because of unreasonable demands by the
Client; or unreasonable working conditions; or a change in the job description; or a change in location;
or a breach of the employment contract by the Client or employment regulations (including pay).
iv. the Client is still intending to employ another Candidate and the Agency is given 6 weeks to find a
suitable replacement and does not use another source to find a replacement.
b. If the Client has not met the above conditions then the Client is responsible for full payment of the
initial invoice. Should the Client find the Candidate unsuitable and still retains the Candidate under
their employment, Kidtection will offer no refund to the Client.
c. Once one free replacement has been found, there are no further refunds or replacements offered.
d. if the Agency does not find a replacement within 8 weeks the Client may claim a percentage of the
refund minus a £250 administrative fee. The refund scale is as follows:
i. If the Candidate leaves within the first 2 weeks: 75%
ii. If the Candidate leaves within week 2 to 3: 60%
iii. If the Candidate leaves within week 3 to 4: 50%
iv. If the Candidate leaves within week 4 to 5: 40%
v. If the Candidate leaves within week 5 to 6: 30%
vi. If the Candidate leaves within week 6 to 7: 20%
vii. If the Candidate leaves within week 7 to 8: 10%
If a Client withdraws an offer of confirmed employment or cancels the confirmed booking less than 14
working days prior the Candidates agreed start date, a 35% of full placement fee will be payable by
the Client to the Agency. In addition the Client is expected to pay the Candidate 1 week’s pay.
The Agency endeavours to provide the Client with only the most suitable Candidates. However
the Client must satisfy itself as to the suitability of the Candidate prior to making an offer to the
Candidate. The Client may take up references and obtain confirmation of the Candidates’ documents.
The Agency does not accept any liability for any kind of inconvenience, loss or damage howsoever
arising and whether caused directly or indirectly from an act or omission of a Candidate introduced
by the Agency. Similarly no warranty is offered in respect of the suitability, honesty, capability or
character of any Candidate introduced by the Agency and employed by the Client. Candidates are
not the employees of the Agency. The Client is responsible for ensuring that their home contents
insurance includes cover for Employers and Public Liability insurance for domestic workers, including
childcarers. The Agency is not liable for any losses, personal injury or death resulting from its
8. Employment contract
Kidtection holds no responsibility for the Client and Candidate’s employment contract and such
matters are to be arranged between the Client and Candidate. The Agency may offer a template
Employment Contract, which the Client may use as a guide or point of reference. Once the contract
between the Client and Candidate is drawn, the Client is responsible for the submitting a copy to
Kidtection. This is in line with The Conduct of Employment Agencies and Employment Business
Regulations 2003 (effective April 6, 2004). The Client assumes full legal responsibility for their
employee’s Tax and National Insurance deductions.
9. Candidate’s responsibilities
a. The candidate will not disclose personal information or any forms of contact which may enable the
Client to contact the Candidate directly.
b. There is no charge for the Candidate to join the Agency. Kidtection may use Candidate’s
information on the website with prior consent from the Candidate. The Agency acts only as an
introduction service between the Candidate and prospective Clients and will refer their name and
portfolio to suitable Clients.
c. The Candidate must contact the Agency within 2 working days should they be offered employment
by a Client directly or indirectly.
d. The Agency may terminate any contract or agreement with the Candidate at any time for any
e. The Agency cannot guarantee a Candidate will be interviewed or hired by any prospective Clients,
nor can the Agency warrant the length of employment the Candidate will have once hired.
f. The Candidate cannot work for anyone else using the Kidtection name and reputation. The Agency
will not provide any representation or warranties of negotiating any wages, loss of wages, termination,
and working conditions that result or may result in working for the Client. The Candidate is not under
any legal obligation to work and therefore understands that Kidtection is not responsible for any
claims, liabilities, injuries, demands, suits, actions, and causes of actions of every kind arising out of
or resulting from the action of The Agency, the Client or the release of any information by the Agency.
The Candidate agrees to these terms and conditions once a registration form is sent to Kidtection.
a. The Client must not disclose any information of Candidates to 3rd parties. A breach of this may
incur additional fees by the agency which is payable 7 days from an invoice.
b. The Candidate must not disclose personal information about interviews, Clients and their families
unless to the Agency. A breach of this may incur fees which are payable 14 days from an invoice.
a. The Agency may need to obtain proof of identification and address from the Client. This is to
confirm the Client’s personal address before arranging interviews with Candidates.
b. The Client is responsible for paying the agreed salary to the Candidate. The Client is responsible
for registering with HMRC and is accountable for the Candidate’s tax and NI contributions.
